We sketch the social and politicalarguments that were mobilized to support sterilization, as well asthe jurisprudence that developed alongside these arguments fromthe 1910s through the 1930s.State courts were initially slow to accept sterilization until theUnited States Supreme Court’s decision in 1927 in Buck v.
Bell.Following this decision, courts and legislatures around theUnited States more readily accepted these practices, even as legalscholars expressed reservations about sterilization. For nearlytwo decades, until the United States’ entrance into World War II,sterilization was broadly accepted by courts. But the UnitedStates Supreme Court’s decision in Skinner v.
Oklahoma in 1942began to turn the tide against sterilization, as did unease with aprocedure that was reminiscent of practices touted in NaziGermany. Yet, even after Skinner v. Oklahoma and the end ofWorld War II, as the rest of the nation began to abandonsterilization, sterilizations continued in North Carolina.The legal basis for allowing sterilization in North Carolina wasthat procedural safeguards could overcome any concerns aboutinfringement of personal liberty. This same due process,however, ultimately required the state to develop machinery tofacilitate sterilization.

Oklahoma4 in 1942 shined little “lighton what they or their successors would do with milder eugenicmeasures, except to make clear that they would be zealous in insistingupon strong scientific support for the necessity and the efficacy ofprophylactic prescriptions and upon adequate procedural safeguardsin picking the persons subjected to them.”5 Later Powell observedthat Skinner v. Oklahoma, which struck down Oklahoma’s lawpermitting sterilization of those convicted of three felonies, would notbe a “stumbling block in the way of any sane public health programhowever much it may intrude on privacy and precludeselfdetermination.”6Powell’s article was published while North Carolina was in themidst of a decades-long program of sterilization.
